We, Crunchfox – a brand owned and operated by PMF Private Limited, a company duly incorporated under the Companies Act, 2013, having its principal place of business at Mirchabari, India (“Crunchfox” / “We” / “Our” / “Us”).
Crunchfox is an e-commerce platform offering a range of packaged food and snack products including, but not limited to, roasted and flavoured makhana (fox nuts), banana chips, date-based snack products, chocolate-coated dates and other associated food items, sold under the brand name “Crunchfox” through the website https://crunchfox.in (the “Platform”).
We respect the privacy of everyone who visits or uses the Platform. This privacy policy (“Privacy Policy”) describes the procedures for collecting, using, storing, and disclosing Your information that You share with us while accessing the Platform or purchasing Products (“Personal Information”). This Privacy Policy shall be read along with the Terms of Use and other applicable policies of the Platform, as updated from time to time. We encourage You to read this Privacy Policy carefully to understand our approach towards the use and protection of Your Personal Information.
We do not knowingly disclose Your Personal Information to third parties except as provided under this Privacy Policy. We take reasonable steps to safeguard and protect the Personal Information collected from You.

“Products” shall mean packaged food and snack items offered for sale on the Platform, either in individual packaging or bundled formats, along with associated Products available on the Platform. Products include, without limitation:
i. Flavoured Makhana (Fox Nuts) – including but not limited to Peri-Peri, Black Salted Pepper, Cheese-Pop, Minty, Tomato Tang, Choco-Pop and other variants;
ii. Banana Chips – including flavoured varieties such as Salted, Peri-Peri, Chilli Tomato Tang, Creamy Onion and similar options;
iii. Date-based Products, including:
a. Dates Bites;
b. Dates Chocolates;
iv. Any other packaged food or snack products introduced by Crunchfox from time to time.
“Users” or “You” or “Your” or “Yourself” shall mean any individual or entity who accesses, registers, browses, or purchases Products through the Platform.
“Visitor” shall mean any individual who accesses, scrolls, or browses the Platform without purchasing any Products.
3. INFORMATION WHICH IS COLLECTED AND STORED
When a User accesses the Platform or creates an account on the Platform, this Privacy Policy comes into immediate effect with respect to the User’s Personal Information collected by Crunchfox. We collect Personal Information from You that we consider necessary for achieving the purpose of providing You with Products and services. However, any Visitor who accesses the Platform by means of browsing or scrolling, without sharing any Personal Information, shall also immediately come under the purview of this Privacy Policy and all the legal obligations mentioned hereunder shall be applicable unless otherwise specifically excluded.

Users understand and acknowledge that the User shall be solely responsible for the accuracy and truthfulness of the Personal Information shared with us. In the event the User is sharing any Personal Information on behalf of a third person, the User represents and warrants that the User has the necessary authority to share such Personal Information with Crunchfox, and Crunchfox shall not be responsible for verifying the same. The User further understands and agrees that all Personal Information shall be subject to the terms and conditions of this Privacy Policy.
We may also collect Personal Information related to Your activity on the Platform, such as the date and time of login, features of the Platform used by You, time spent on various pages, product interactions, searches, abandoned cart data, wishlist items, and information about the User’s device. We may additionally collect aggregated and anonymized purchase trends, clicks, and pages visited.
Further, we may collect data regarding Your location (if permissions are granted), IP address, browser type, operating system, referral URLs, and diagnostic data. i. Contact: The Platform may require permission to access Your contact details for purposes including but not limited to order processing, delivery coordination, customer support, and communication related to Products or services offered by Crunchfox.
ii. SMS and Email ID: In order to verify One-Time Passwords (OTP) sent for account creation, login authentication, order confirmation, or payment verification, the Platform may require access to Your SMS and Email ID. Such access shall be used solely for verification and communication purposes in connection with Your use of the Platform.
6. HOW WE USE PERSONAL INFORMATION
Personal Information is collected and used by Crunchfox for the following purposes:
i. To deliver the Products ordered by You to Your desired delivery location.
ii. To monitor Your activity on the Platform, such as searches, browsing behavior, and interactions, and to manage traffic on the Platform more effectively.
iii. To create, maintain, and administer Your account and to improve the quality of, as well as Your experience with, the Platform and Services.
iv. To customize and personalize Your experience on the Platform.
v. To assist You with technical issues, order-related queries, and customer support requests.
vi. To manage and maintain our relationship with You as a User of the Platform.
vii. To maintain, update, and manage our internal records.
viii. To enable You to receive information, updates, offers, and notifications about new products, arrivals, or promotions through email, SMS, or other communication channels.
ix. To monitor, prevent, and investigate suspected fraud, misuse, misconduct, or unlawful activities on the Platform.

You agree that Crunchfox may also use Your Personal Information to contact You and provide information that may, in some cases, be tailored to Your interests, including promotional communications, offers, and updates relevant to Your use of the Platform. By accepting this Privacy Policy, You expressly consent to receiving such communications.
The information collected by Crunchfox may also be used for purposes permitted under applicable laws, including providing a personalized browsing experience, conducting internal research and analytics, improving marketing and promotional efforts, and enhancing Platform content and performance. Wherever possible, such data is processed in an aggregated or anonymized manner to protect User privacy.

Personal Information required for fulfilling orders is shared with delivery partners solely for the purpose of order dispatch and delivery.

7. CHILDREN’S PRIVACY
The Platform operated by Crunchfox is not directed at anyone whom We know to be under the age of 18 years, nor do We knowingly collect any Personal Information from individuals under the age of 18.

Such patterns and insights are derived from observation and analysis of Your usage of the Platform, including browsing behavior, purchase history, and interactions. You understand and acknowledge that such derived data may not always be complete, accurate, comprehensive, or correct. However, it is used solely to help Crunchfox understand User behavior, improve services, personalize User experience, and offer better Products and recommendations to You.

We value Your Personal Information and are committed to ensuring an adequate level of protection. Crunchfox has implemented reasonable technical and organizational security measures, policies, and procedures with the objective of protecting Your Personal Information from unauthorized access, misuse, loss, alteration, or disclosure. All Personal Information collected by Crunchfox is stored on secure servers hosted by third-party service providers. All third-party integrations, including but not limited to payment gateways, logistics partners, and technology service providers, are bound by strict data protection and data-sharing agreements to ensure compliance with applicable privacy and data protection laws.

If You choose to share Your account credentials or Personal Information with any third party, You do so at Your own risk and shall be solely responsible for all consequences arising therefrom. In the event You lose control of Your password or account, You may lose substantial control over Your Personal Information and may be subject to legally binding actions taken through Your account.
12. INTERACTION BETWEEN YOU AND PLATFORM
We are interested in Your views and value the feedback (as defined below) that we receive from You. However, Crunchfox does not control and shall not be responsible for any such feedback or for any Personal Information that You choose to make available or disclose through the Platform. We encourage You to exercise caution while sharing any Personal Information through the Platform.
Subject to applicable laws, any communication, content, or feedback sent by You to the Platform, including without limitation testimonials, reviews, comments, suggestions, ideas, opinions, or other materials (collectively referred to as “Feedback”), shall be deemed to be non-confidential. Crunchfox shall be under no obligation to refrain from reproducing, publishing, displaying, modifying, distributing, or otherwise using such Feedback for any purpose whatsoever.
You acknowledge and agree that Crunchfox may freely use the Feedback, including without limitation any ideas, concepts, inventions, techniques, suggestions, or know-how disclosed therein, for any purpose including but not limited to product development, improvement, manufacturing, marketing, promotional activities, or service enhancement, without any restriction or obligation to You.
You further agree that You shall not assert any ownership rights of any kind in the Feedback, including without limitation copyrights, patents, trademarks, moral rights, unfair competition claims, or implied contractual rights. You hereby irrevocably waive any right to receive any compensation, consideration, or acknowledgment in connection with the use of such Feedback, including recognition as the source of the Feedback.
13. ACCESSING AND MODIFYING PERSONAL INFORMATION
In case You wish to access, review, remove, or modify the Personal Information that You have provided to Crunchfox, You may do so directly by logging into Your account on the Platform. You can update or correct Your account credentials and Personal Information, including but not limited to Your name, delivery address, mobile number, or other relevant details, as applicable, through the account settings available on the Platform.
You acknowledge and agree that it is Your responsibility to ensure that the Personal Information provided by You is accurate, complete, and up to date. Crunchfox shall not be responsible for any issues, delays, or failures arising due to incorrect or outdated information maintained by You in Your account.
14. THIRD PARTY LINKS
If there happen to be any links to other platforms on the Platform, or if You are redirected to the Platform through a link from another third-party platform, Crunchfox shall not be responsible for the privacy policies, content, or practices of such third-party platforms. Any information, content, or services provided by such third-party platforms shall be governed by their respective terms of use, privacy policies, and other applicable guidelines.
We recommend that You review the privacy policy and terms of use of each third-party platform that You visit in order to better understand Your rights and obligations, especially when You submit any Personal Information or other content on such platforms. Crunchfox shall not be liable for any loss, damage, or misuse of information arising from Your interaction with any third-party platform. For any concerns or queries related to such third-party platforms, You are advised to directly contact the respective owner or operator of that platform.
15. SOCIAL MEDIA
You may choose to participate in social media avenues made available on the Platform. The primary objective of such social media features is to facilitate and allow You to share content. You acknowledge that any Personal Information shared by You on social media platforms may be publicly accessible and viewable by others, and Crunchfox does not have control over the audience or subsequent use of such information.
You understand and agree that Crunchfox shall not be responsible or liable if You choose to share Personal Information on any social media platform and such information is subsequently used, misused, copied, distributed, or otherwise appropriated by any third party or other users. You are advised to exercise discretion and caution while sharing any Personal Information through social media features associated with the Platform.
16. LOGOS, CONCEPTS, IDEAS
We exclusively develop our logos, concepts, ideas, designs, and creative materials for use in advertising, promotion, public relations, and other activities appropriate to promote our Products and services. You are not permitted to misuse, copy, steal, reproduce, modify, distribute, or otherwise use any of our creations, logos, brand elements, or content appearing on the Platform for any purpose without prior written permission, and any such unauthorized use may attract legal action.
The logo and brand name “Crunchfox” are proprietary assets and trademarks owned by PMF Private Limited, and are protected under applicable laws of India. All rights in and to the logos, brand names, concepts, ideas, and creative works are expressly reserved.
Any reference to Crunchfox, unless repugnant to the context, shall be deemed to include its successors, affiliates, and permitted assigns.
17. INDEMNIFICATION
In addition to the indemnification commitments provided under the Terms of Use, You agree to indemnify, defend, and hold harmless Crunchfox, its parent company PMF Private Limited, and its partners, affiliates, directors, officers, employees, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorney’s fees) arising out of or relating to:
i. the accuracy, completeness, and correctness of any Personal Information or content that You submit, upload, publish, or share through the Platform;
ii. Your violation of this Privacy Policy or any applicable Terms of Use;
iii. Your infringement or violation of any rights (including privacy, intellectual property, or contractual rights) of any other User or third party.
18. RESERVATION OF RIGHTS
All rights not expressly granted under this Privacy Policy are reserved by Crunchfox. Nothing contained in this Privacy Policy shall be construed as conferring, by implication, estoppel, or otherwise, any license or right under any copyright, patent, trademark, or other intellectual property right of Crunchfox, its parent company PMF Private Limited, or any other person, to the User.
19. LIMITATION OF LIABILITY
The Platform shall not be liable for any damages, whether direct or indirect, incidental or consequential, and all liabilities (including but not limited to negligence, loss or damage such as loss of revenue, unavailability of the system, loss of data, or loss of Your Personal Information) arising out of or in connection with the use of, or inability to use, the Platform or the Products offered thereon. Crunchfox shall not be liable to provide any indemnity or any other remedy to You or to any third party in this regard.
While Crunchfox makes reasonable efforts to ensure that the Platform is secure and free from defects, bugs, or viruses, we do not guarantee that the Platform will be uninterrupted or error-free. It is Your responsibility to ensure that You use appropriate and compatible devices for accessing the Platform and take adequate precautions to protect Your device, data, and systems from potential damage.
20. GOVERNING LAW AND DISPUTES
This Privacy Policy shall be governed by and interpreted in accordance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, as amended from time to time, and other applicable laws of India, which are intended to protect Personal Information.
This Privacy Policy shall be governed by and construed in accordance with the laws of India. The acceptance of this Privacy Policy shall be deemed to have been given at Katihar, Bihar, India, and the courts located at Katihar, Bihar shall have exclusive jurisdiction to entertain any proceedings arising out of or relating to this Privacy Policy or any rights, duties, obligations, or liabilities arising hereunder, to the exclusion of all other courts in India.

22. USER ACCOUNT DEACTIVATION
Users may request deactivation or deletion of their account by contacting Crunchfox support through the Platform or the officially provided contact details.
Upon receipt of a valid and verified account deletion request, Crunchfox shall make reasonable efforts to delete or anonymize the Personal Information associated with the User’s account.
